Apple Wins the Lawsuit against Samsung new Galaxy tablet thereby successfully halting the sales of Samsung tablet in Germany.
According to the district court in Düsseldorf ruled on Friday, Samsung must immediately stop the sales of its new Galaxy.
Sounds like Apple will not stop until it shuts down Samsung. I say, its a Battle of Survival between Apple and Samsung!
Earlier last month, Apple successfully appealed in a German court and banned the sales of Samsung new tablet in European countries terming the latter’s tablet as copied.
In the successive months, Apple has really meant business. First it prevented the sales of Samsung galaxy in European countries, then in Japan, soon in US and Australia. Apple seems to have taken Samsung as a fierce rival.
Samsung will appeal the decision in the Düsseldorf Higher Regional Court, a spokesman said.
“We are disappointed with this ruling and believe it severely limits consumer choice in Germany,” he said via email.
“By imposing an injunction based on this very generic design right, this ruling restricts design innovation and progress in the industry,” the Samsung spokesman said, adding that the decision is inconsistent with the August 24 ruling by a Dutch court on a separate case involving the two companies, which found the designs of Samsung’s Galaxy products don’t violate Apple’s design right.
